§ 1 Scope

  1. These terms and conditions apply to all contracts for cosmetic services, treatment packages and the sale of products in the Dermacare institutes. The contracting party is the operator of the location at which the service is booked or provided (hereinafter the “operator”):
  2. Dermacare City, Morzinplatz 4, 1010 Vienna: Dermacare GmbH, Gonzagagasse 2/5, 1010 Vienna, FN 579162 i. Dermacare Donaustadt, Erzherzog-Karl-Straße 7A, 1220 Vienna: BelCorpo GmbH, Erzherzog-Karl-Straße 7A/2, 1220 Vienna, FN 614424 s. BelCorpo GmbH is a legally and economically independent company and operates its location as a franchisee of Dermacare GmbH. Each operator is only liable for the contracts it has concluded.
  3. For consumers within the meaning of the Austrian Consumer Protection Act (KSchG), these terms and conditions only apply insofar as mandatory statutory provisions do not conflict with them.
  4. Deviating agreements only apply if they have been confirmed in writing (including by email).

§ 2 Medical services

  1. Medical treatments (for example botulinum toxin, fillers, threads, PRP, laser treatments under medical responsibility, dermatological services) are provided by self-employed physicians on their own responsibility. The treatment contract is concluded exclusively with the treating physician.
  2. The operator provides premises, equipment and staff for this purpose and handles appointment scheduling, organisation and, where agreed, collection in the name and for the account of the physician.
  3. Medical information, consent and documentation are provided by the treating physician. §§ 4 (appointments) and 5 (payment) of these terms and conditions also apply to medical services insofar as the physician makes them part of the treatment contract.

§ 3 Conclusion of contract and cooperation

  1. Prices stated on the website, in social media and in advertising material are non-binding. The price according to the cost estimate or the current price list at the time of booking is decisive.
  2. A contract is concluded upon confirmation of the appointment (SMS, email or online booking) or upon commencement of the treatment.
  3. The customer completes the medical history questionnaire fully and truthfully and informs the operator of any changes before each treatment (in particular pregnancy, medication, blood thinners, allergies, skin diseases, sun exposure). The operator may refuse or discontinue a treatment if it is not justifiable for professional reasons.
  4. A particular treatment result cannot be guaranteed. The number of sessions required varies from person to person.

§ 4 Appointments, cancellation and no-shows

  1. Appointments can be cancelled or rescheduled free of charge up to 48 hours before they begin, by phone, email, WhatsApp or via the link in the appointment confirmation.
  2. In the event of a later cancellation, the operator charges a cancellation fee of 50% of the price of the booked treatment. In the event of a no-show without cancellation, the cancellation fee is 100%. The cancellation fee is capped at €150 for a late cancellation and €300 for a no-show per appointment. Material not used (for example fillers or botulinum toxin) is not charged.
  3. No cancellation fee is charged if the customer is prevented from attending through no fault of their own (for example an acute illness with a medical certificate) or if the appointment could be given to someone else. The customer is free to prove that the operator has suffered no damage or less damage.
  4. For packages, a session that is not cancelled in time counts as used; instead of the fee under paragraph 2, one session is deducted from the package.
  5. If the customer is more than 15 minutes late, the treatment may be shortened or moved to a new appointment; paragraph 2 applies accordingly.
  6. If the operator has to cancel an appointment, the customer will be informed as early as possible and offered an alternative appointment. Amounts already paid will be refunded on request.

§ 5 Prices and payment

  1. All prices are final prices in euros including VAT, where applicable.
  2. Payment is due when the service is provided. Payment can be made in cash, by debit or credit card or by bank transfer.
  3. For complex treatments or for new customers, the operator may request a deposit of up to 30%; this is credited against the price.
  4. Instalment payment: The operator may agree a written payment plan. Instalment payments are free of interest and charges. If the customer is more than 14 days in arrears with an instalment, the operator may, after a written reminder with a grace period of 14 days, declare the outstanding balance due. Financing via external providers is subject to their terms and conditions.
  5. In the event of late payment, the statutory default interest applies. Reminder costs are only charged in a reasonable amount.

§ 6 Treatment packages

  1. Packages (for example 6 or 8 sessions) are purchased from the operator of a location and used there. They must be paid for in advance and are personal and non-transferable, unless otherwise agreed.
  2. Packages must be used within 2 years of purchase. On request, the period will be extended if there are medical reasons.
  3. If the customer cannot or does not wish to use a package in full, the operator refunds the package price less the sessions used at the single price without package discount.

§ 7 Vouchers

  1. Vouchers are sold by Dermacare GmbH; it is the contracting party for the voucher purchase. Vouchers can be redeemed at both locations. When redeemed at Dermacare Donaustadt, BelCorpo GmbH provides the service.
  2. Value and treatment vouchers are valid for 5 years from the date of issue. The expiry date is stated on the voucher.
  3. Vouchers are transferable and can be redeemed in several parts. Cash payment is excluded to the extent permitted by law.
  4. For treatment vouchers, the price at the time of purchase applies; a later price increase is not charged retrospectively.
  5. Promotional vouchers and free vouchers may have a shorter validity period; the period is stated on the voucher.
  6. For vouchers purchased online, there is a 14-day right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG). Information on the right of withdrawal and the model withdrawal form are provided at the time of purchase.

§ 8 Products and warranty

  1. The statutory warranty applies to products sold.
  2. For hygienic reasons, opened care products are not taken back unless they are defective.

§ 9 Liability

  1. The operator is liable for damage resulting from injury to life, body or health in accordance with the statutory provisions.
  2. For other damage, the operator is only liable in the event of intent or gross negligence. Towards consumers, liability for slight negligence in the case of personal injury remains unaffected.
  3. Liability for clothing and valuables brought along is limited to gross negligence.
  4. The treating physician is liable for medical services (§ 2).

§ 10 Photo and video recordings

To document the course of treatment, photos of the treated area are taken before, during and after the treatment. They are part of the treatment documentation and are used internally only. They are only used for advertising (website, social media) with separate written consent, which can be withdrawn at any time.

§ 11 Data protection

Information on the processing of personal data can be found in the privacy policy at dermacare.at/en/privacy-policy.

§ 12 Final provisions

  1. Austrian law applies, excluding its conflict-of-law rules. For consumers, the place of jurisdiction pursuant to § 14 KSchG applies.
  2. Should any provision be invalid, the remaining provisions remain valid.
  3. These terms and conditions are available at dermacare.at and are displayed at both locations.
